DMCA Policy

Builder.io, Inc. ("Builder") respects intellectual property rights and expects customers and their users to do the same. This policy describes how Builder responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512, with respect to content hosted on or made available through the Services, including Customer Applications.

1. Designated Copyright Agent

2. Filing a Notice of Infringement

To file a notice, provide our Copyright Agent with a written statement that includes:

1. a physical or electronic signature of the copyright owner or authorized person;

2. identification of the copyrighted work claimed to have been infringed;

3. identification of the material claimed to be infringing, with sufficient information to locate it (such as the URL or project identifier);

4. your contact information (name, address, telephone number, email address);

5. a statement of good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and

6. a statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on their behalf.

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages.

3. Builder's Response

Upon receiving a valid notice, Builder will act expeditiously to remove or disable access to the allegedly infringing material and will take reasonable steps to notify the affected customer. Builder may suspend or terminate accounts associated with repeated or egregious infringement.

4. Counter-Notification

If you believe your material is not infringing or your material was removed or disabled by mistake or misidentification, you may submit a counter-notification that includes:

1. your physical or electronic signature;

2. identification of the material removed or disabled, and the location where it appeared before removal;

3. a statement, under penalty of perjury, of a good-faith belief that the material was removed as a result of mistake or misidentification;

4. your name, address, telephone number;

5. if you are located in the United States: a statement that you consent to jurisdiction of the Federal District Court for the district where you reside;

6. if you are located outside the United States: a statement that you consent to any United States federal district court where Builder is located; and

7. a statement that you will accept service of process from the person who provided the notification or that person's agent.

If Builder receives a valid counter-notification, Builder may restore the material within 10-14 business days unless the copyright owner files a court action.

5. Repeat Infringer Policy

Builder will terminate the accounts of customers who are determined to be repeat infringers.
